1. Scope of the Consumer Promotion

This consumer promotion (“Promotion”) is sponsored and brought to you by Unipex Dairy Products Co Ltd, (“UNIPEX”) and organized by our partner agency TLC Marketing Worldwide Middle East DMCC (“Agency”)

Note: Any reference to “We”, “Us”, and “Our” shall mean UNIPEX and Agency and reference to “You”, “Your” shall mean the Participant.

These Terms and Conditions apply to the Promotion and aspects thereof. By participating in the Promotion, the Participants fully and unconditionally agree to have read and accepted these Terms and Conditions.

2. Definitions

1. “Promotion” shall mean the “Tiffany Finns Spin & Win Consumer Promotion”
2. “Promotion Period” shall mean the period of the Promotion mentioned under clause 3 of the Terms & Conditions.
3. “Participant” (s) shall mean any customer participating in the Promotion upon successfully following the steps mentioned under clause 5 of the Terms & Conditions.
4. “Terms & Conditions” shall mean these Terms and Conditions for the Promotion.
5. “Promotion Territory” shall mean the territories mentioned under clause 4.1 of the Terms & Conditions.
6. “Prize” shall mean the prize as mentioned under clause 6(i) of the Terms & Conditions.
7. “Product” shall mean any Tiffany Finns 85g and 170g variants which has the promotional call out of ‘Spin and Win’ mentioned on the pack. Each Product variant may have different production and expiry dates.

3. Promotion Period

1. The Promotion will commence from 1st October till the expiry date mentioned on the purchased Product (“Promotion Period”). Explanation: You can participate any time before the expiry date of the purchased Product.
2. We reserve the right to cancel/amend/extend the Promotion Period. Any such change in the Promotion Period shall be reflected in the terms and conditions available on the website of the Promotion and no request or questions shall be entertained in this regard, in any manner.
3. Entries received outside the Promotion Period will not be eligible for the Promotion.

4. Eligibility & Promotion Territory

1. This Promotion will be applicable in the following emirates of United Arab Emirates (“UAE”):
   1. Abu Dhabi
   2. Dubai
   3. Sharjah
   4. Ajman
   5. Umm Al Quwain
   6. Ras Al Khaimah
   7. Fujairah
2. This Promotion is open to participate for all the residents of UAE and/or any person visiting UAE during the Promotion Period. Note: The Prize(s) shall be only redeemable in the selected locations as mentioned under Prize clause i.e. 6.
3. Any person in UAE, over (18) years of age at the time of entry can participate in the Promotion. In case a person younger than the age of (18) has purchased the Product, they should only participate with their Parents or guardian for claiming the Prize. We do not knowingly accept participation from minors.
4. We may require evidence or confirmation from Participants before awarding prizes.
5. We reserve the right to exclude any person from participating in the Promotion on grounds of misconduct, misrepresentation, coercion, fraud, deceit, breach of the Terms and Conditions. In such cases, we may disqualify the Participant and require the return or reimbursement of any Prize even if it has already been awarded or provided. No communication in this regard from the Participant or their representatives shall be entertained by us.
6. Participation in this Promotion and the content of these Terms & Conditions are subject to restrictions and changes as may be contained in the applicable laws of the UAE.

5. How to Participate

1. Steps to participate are as follows:
   1. Buy the Product and locate the QR code on the Product
   2. Scan the QR code on the Product
   3. Visit the microsite, register and enter the unique code found inside the pack.
   4. Once successfully registered, the Participant will receive a reward detail with the claim code and individual instructions per reward on the registered email of the Participant.
   5. The reward must be claimed within one month (30 days) of receipt of the email.
2. Each valid unique code will receive one (1) Prize for every valid and complete entry submitted successfully on the redemption platform.
3. Participants shall, in good order, retain the promotional packaging of the Product as it may be required for verification. We reserve the right to request proof of a Participant’s identity in the form of proof of residence/passport. In the event that a Participant cannot provide us with such proof, we may withdraw the Prize and select another winner in the same manner as the first.
4. Deficient entries: We will not be responsible for any entries not received, not recognized, not accepted for any reason or delayed for any reason whatsoever. Proof of sending or entering such details does not constitute receipt.
5. The use of any automated software or any other mechanical or electronic means that allows an individual to automatically enter the Promotion is prohibited.
6. Participants must enter the Promotion using their real name and email address. Fake names or emails, or using the same unique code with multiple email ids, can lead to disqualification and you may have to return any Prize, you win.
7. Employees of the UNIPEX, its subsidiaries, divisions, affiliates, authorized dealers/distributors, agents and their immediate family members are not eligible to enter the Promotion. UNIPEX reserves the right to disqualify any such person from receipt of any prize and/or require the return of any prizes awarded, when notified. In such an event, and subject to any legal requirement, UNIPEX reserves the right to select a new Participant for the prize and/or dispose off the prize in any manner it deems fit, in its sole discretion.
8. The Prizes under this Promotion are free of cost and the Participants are not required to pay for the same or send any money or share any bank or card details with us. Standard SMS/ Internet charges may apply during the redemption process.
9. We shall not be responsible for any loss or damage to the Participant if any money is paid, transferred or bank/card related details are shared by the Participant.

6. Prizes

The Participants will get a chance to win one of the following prizes:

1. The Participants will be contacted via the email address provided during participation (ensure to put correct Email ID. No other email ID will be considered for further communication if Email ID is wrongly entered in the Promotion).
2. The Participant shall claim/redeem the prize within (30) days of intimation failing which we shall be at liberty to choose another winner or disperse the Prize at its own discretion.
3. When redeeming the Prize, the Participants shall be governed by the terms and conditions of the respective third-party websites offering the Prize. We shall have no liability in relation to any Prize, its fitness for purposes, merchantability or otherwise. While these third-party websites are selected with care, we cannot accept liability for the use of your personal data by these organizations.
4. Participant acknowledges and agrees that Participant’s use of third-party services in connection with the Prize will be subject to the terms and conditions and privacy policies of such third-party prize provider and we shall not be liable for Participant’s enablement, access or use of such third-party services, including Participant’s data processed by such third-party prize provider. Participant should contact that third-party prize provider for any issues arising in connection with use of such third-party service in connection with the Prize. We will not be in a position to offer commitments on timelines or quality of service on behalf of such third-party prize provider.
5. We reserve the right to substitute any Prize for another prize of similar value.
6. The Prize under this Promotion is not transferable, can’t be traded, exchanged, sold, replaced or adjusted with anything including other prizes/ gifts/ benefits in lieu thereof, if any or cash except at our sole discretion.
7. All Prizes are subject to availability. In case the Participant does not claim/redeem the type of Prize won at or within the time stipulated by us (or any relevant third party prize provider) then that Prize will be forfeited by the Participant and no replacement prize will be granted. No cash will be awarded in lieu of that Prize or part of it
8. Any tax payable as a result of a Prize being awarded or received will be the responsibility of the Participant. Participant should seek independent financial advice prior to accepting a Prize if this is a concern.
9. Any pictures depicting the Prizes on any media or promotional material are for depiction purposes only and in certain instances the actual Prizes may differ. The Promotion does not constitute an endorsement or recommendation of the products or services being offered as Prizes.
10. Each Participant will be solely responsible and will bear all costs for any meals, transport, insurance, duties, taxes, licenses, permits, approvals and/or other additional or incidental costs or expenses which may be incurred as a result of and/or related to the winner's acceptance of their Prize, including but not limited to any registration fees incurred for the use of their Prize (IF APPLICABLE).

7. Personal Information & Intellectual Property

1. Participant acknowledges and agrees that we may collect personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, coupon suppliers and as required, to regulatory authorities.

3. Participant gives us the right at no additional cost to use their name, image, likeness, and/or photograph anywhere in the world, for editorial, advertising, promotional, and marketing purposes related to the Promotion, unless prohibited by law.
4. Participants hereby consents to the use of their personal information in the manner set out in these Terms & Conditions and waives their rights to initiate any claim against UNIPEX for privacy invasion, disclosure of personal information or any other related claims.
5. Any third-party intellectual property used in any of the promotional material/vouchers are the property of that respective entity and UNIPEX does not claim any rights or association, partnership, sponsorship with those companies. The intellectual property used on those vouchers of those third parties is only an indication of the source of such Prize being that entity.
6. Any intellectual property used on the promotional materials/vouchers is as per the brand guidelines of the respective entities. UNIPEX is not responsible for any breach of such brand guidelines.

9. General Terms

1. In the event of any conflict or inconsistency with any other communications, including advertising or promotional materials for the Promotion, the Terms and Condition shall prevail. We reserve the right to amend these Terms and Conditions. Any such change will be reflected on the promotion website with the last updated date.
2. Each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering into the Promotion, the Participant warrants that all information provided by Participant regarding Participant's name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.
3. If for any reason this Promotion is not capable of being carried on as planned, We, to the fullest extent permitted by law, reserves the right in its sole discretion to cancel, terminate, modify or suspend this Promotion and to disqualify any Participant who tampers with the Promotion and/or the entry process. To the fullest extent permitted by law, UNIPEX is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer software and/or equipment, failure of any e-mail account or any combination thereof including any injury or damage to any participant's or any other third person's, resulting from any participation.
4. We make no representation or warranty regarding the Prizes provided and will not be liable for any Prizes that are lost, delayed, misplaced, stolen, damaged, non-functional, misused, or negligently used by the Participant. We shall not be liable for any loss or damage whatsoever, including but not limited to indirect or consequential loss, or for any death or personal injury suffered or sustained as a consequence of participation in the Promotion, all to the fullest extent permitted by law.
5. We shall not be liable to perform any of its/their respective obligations under the Promotion or in respect of the Prize where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, epidemic, pandemic, quarantine or any other force majeure condition, etc., and shall not be liable to compensate or pay damages to the Participant in these circumstances.
6. We shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Promotion due to any law-and-order situation or government restrictions/ judicial pronouncements.
7. We accept no liability, whether jointly or severally, for any errors or omissions, in relation to Participant’s participation in the Promotion. The Participant shall be solely responsible for any consequences which may arise from his/her participation in the Promotion. Participant also undertakes to indemnify UNIPEX and its officers, directors, employees, representatives and agents, on the happening of any illegal acts committed by the Participant.
8. The Participants acknowledge that the quality of the Prize, and the services of the courier service are not controlled or supervised by UNIPEX, hence any issue with relation to delay in delivery or damage in transit shall have to addressed to the Courier delivery partner and defect in Prize or Prize related services shall have to addressed to the manufacturer or service provider of the Prize /service alone and UNIPEX shall not be held responsible for it.
9. This Promotion shall be governed by the applicable laws in the UAE and the courts in Dubai shall have exclusive jurisdiction. The Promotion may be conducted, extended, amended or withdrawn at the sole discretion of UNIPEX without any claim, compensation or contest.
10. No queries, claims, dispute, complaints or grievances shall be entertained by us after 30 days from the date of the closure of the Promotion.
